Buying from a shop on Gemeez
Every shop on Gemeez sells on its own account and hands the goods over itself, by delivery or pickup. The product page says so plainly: «Sold and delivered by <shop name>». This page explains what that means.
The sale is between you and the shop
The sale is a contract between you and the shop. Gemeez gives the shop a page and tools on a monthly subscription. Gemeez takes no payment from the customer and does not deliver the goods. Gemeez is not a party to the sale, and the shop's own terms govern it.
The shop's identity
A shop's page shows the trade name, commercial register number, tax card number and address that the shop has published. The shop enters those details and is responsible for their accuracy (Consumer Protection Law 181/2018, art. 37). If they do not match the shop, report it.
Price and invoice
The price on the page is the price the shop published, and the shop must sell at it. A tax-registered shop shows a VAT-inclusive price; a shop that is not registered charges no VAT. The shop issues your invoice or receipt, and you are entitled to ask for it.
Warranty
The warranty is between you and the shop. The shop prints the warranty card from Gemeez carrying the device number, the warranty months and the date it runs to. Keep the card — it is the paper you return to the shop with.
The 14-day right to withdraw
Law 181/2018 (art. 40) gives a consumer the right to withdraw from a distance purchase within 14 days, on the conditions and exceptions the law sets out. That right is against the shop directly, because the shop is the seller.
If the shop does not deliver
From the shop's page you can report it to Gemeez: charged more than the published price, the item was not there, refused an invoice, refused the warranty, does not answer, or the shop's details are wrong. Gemeez reviews the report and can stop the shop from selling on the platform. What Gemeez does not do is refund the money, because it never took it.
Your personal data
When you send a request to a shop, Gemeez passes the shop your name, phone number, e-mail if you gave one, and your note, because that is what fulfilling your request needs (Personal Data Protection Law 151/2020). The shop sees your phone number after it accepts the request, not before. We erase this data from closed requests after a fixed retention period. If you sent the request while signed in, your account page lets you download a copy of your data, and deleting your account erases these details from your requests. If you sent it without an account, contact us to have it erased.
